TERMS AND CONDITIONS
GAME OF CHANCE – NATIONAL

  1. Information on how to enter and prizes form part of these conditions. By participating, entrants agree to be bound by these conditions. Entries must comply with these conditions to be valid.
  2. Entry is open to residents of Australia aged 18 years of age and over. Employees and their immediate families of the Promoter and its agencies associated with this promotion are ineligible to enter.
  3. To enter, each entrant must, during the Promotional Period:
    1. obtain a promotional flyer featuring a unique code from a Colgate ambassador at a participating shopping centre or participating Coles, Woolworths, Metcash or Priceline store; and
    2. visit www.totalupgrade.com.au and fully complete the online entry form, including full name, address, email address, telephone number and enter the unique code provided on the flyer.
  4. Limit applies of one entry per person.
  5. The promotion commences at 00.01 AEDT on 18/03/19 and closes at 23.59 AEST on 07/06/2019 (“Promotional Period”).
  6. The draw will take place at 10am AEST on 14/06/2019 at Suite 5/210 Central Coast Hwy, Erina NSW 2250. The first 146 valid entries drawn will receive a prize as follows:
    1. The first 4 valid entries drawn will each receive a $250 Flight Centre gift voucher;
    2. The next 15 valid entries drawn will each receive a $119 iTunes gift voucher;
    3. The next 11 valid entries drawn will each receive a $100 Gold Class gift voucher;
    4. The next 25 valid entries drawn will each receive a $80 Netflix gift voucher;
    5. The next 60 valid entries drawn will each receive a $50 Uber gift voucher; and
    6. The next 31 valid entries drawn will each receive a $35.97 Spotify gift voucher.
    There are 146 prizes to be won. Total RRP value of prizes = $10,000.07 All taxes (excluding GST) which may be payable as a consequence of receiving a prize are the sole responsibility of the winner. All other ancillary costs and any and all other expenses incurred as a consequence of receiving the prize are the responsibility of the winners.Gift vouchers are valid for 12 months from date of purchase and will be purchased upon confirmation of winners details following the prize draw on 14/06/2019. All gift vouchers included in the prize must be used before the expiry date (which will be stated on the relevant gift voucher), otherwise the gift voucher will be forfeited. Apple, Spotify, Hoyts, Netflix, Uber and Flight Centre have no relationship to, or involvement with, Colgate Palmolive or this promotion.
  7. Prizes are not transferable and are not redeemable for cash. The Promoter’s decision is final and binding - no correspondence will be entered into.
  8. The Promoter assumes no responsibility for any failure to receive an entry or for inaccurate information or for any loss, damage or injury as a result of technical or telecommunications problems, including security breaches. If such problems arise, then the Promoter may (where necessary with the approval of the relevant lottery authority) modify, cancel, terminate or suspend the promotion.
  9. If any prize becomes unavailable for reasons beyond the Promoter’s control, the Promoter may substitute a prize of equal or greater value, subject to any written directions from the various authorities.
  10. Winners will be notified in writing via email within 2 days of the draw. All reasonable attempts will be made to contact the winners. Prizes will be delivered to winners by 28/06/2019. If a winner is unable to be contacted by 19/09/2019, that winner will forfeit the prize and the prize will be awarded as part of the second chance draw (in accordance with clause 11).
  11. The names of winners (and addresses of any winners in SA receiving a prize valued at over $250) will be published on www.totalupgrade.com.au on 18/06/2019 for a minimum of 28 days.
  12. If necessary, a second chance draw will be held on 20/09/2019 at the same time and place as the first draw in order to distribute any unclaimed prizes. Winners will be notified by email within 2 days of the second chance draw. The names of winners (and addresses of any winners in SA receiving a prize valued at over $250) will be published on www.totalupgrade.com.au.
  13. The Promoter reserves the right to request verification of age, identity, residential address of winners and any other information from entrants relevant to entry into or participation in this promotion. Verification is at the discretion of the Promoter, whose decision is final. The Promoter reserves the right to disqualify any individual who provides false information, fails to provide information, conspires with others to gain an unfair advantage or who is otherwise involved in any way in manipulating, interfering or tampering with the conduct of this promotion.
  14. The Promoter shall not be liable for any loss, damage or injury suffered or sustained (even if caused by negligence) as a result of accepting and/or using a prize, except for any liability which cannot be excluded by law. The prize is subject to the terms and conditions of Apple, Spotify, Hoyts, Netflix, Uber and Flight Centre. The Promoter is not responsible or liable for any loss, damage or injury suffered by any winner as a result of the conduct of Apple, Spotify, Hoyts, Netflix, Uber and Flight Centre or otherwise as a result of the winner accepting and/or using a prize (even if caused by negligence), except for any liability which cannot be excluded by law.
  15. Entrants consent to the Promoter using their name, image and/or voice in the event that they are a winner in any media for an unlimited period of time without remuneration for the purpose of promoting this promotion (including any outcome) and/or promoting any products manufactured, distributed and/or supplied by the Promoter.
  16. Entries remain the property of the Promoter. Details from entries will be collected and used for the purposes of conducting this promotion (which may include disclosure to third parties for the purpose of processing and conducting the promotion) and for promotional purposes surrounding this promotion. By entering this promotion entrants consent to the use of their information as described and agree that the Promoter may use this information, or disclose it to other organisations that may use it, in any media for future promotional purposes without any further reference or payment to the entrant. Entrants may access, change and/or update their personal information and obtain a copy of the Promoter’s privacy policy by contacting the Promoter on (02) 9229 5600 during office hours.
